This Thursday, the House Judiciary Committee is scheduled to mark up the “America Invents Act,” H.R. 1249.
This is a terrible bill that will kill jobs and kill innovation in America. We need you to call your Representative, and tell him or her to vote NO on H.R. 1249.
Article 1, Section 8, clause 8 of the U.S. Constitution gives Congress the power:
“To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;”
The Founding Fathers understood the importance of protecting and encouraging innovation by allowing inventors to profit from their discoveries.
Because of this strong protection, which makes America unique in the world, Americans are responsible for roughly 90% of great inventions.
Large corporations are lobbying hard to get Congress to ignore the Constitution and change our currently strong patent system to a system that favors large corporations over small inventors, making it easier for foreigners to infringe patents, easier to challenge patent rights in administrative proceedings and in the courts, and more expensive for inventors to defend their patents.
All this is being done in an effort to “harmonize” with the rest of the world. Why on earth would we want to harmonize with Asian and European countries that don’t protect intellectual property rights? Other countries should be harmonizing with us to improve their systems.
Canada made similar changes to its patent system in 1989, and it had a negative impact on small businesses and individual inventors and concentrated more power and ownership into large corporations.
As Phyllis Schlafly declared in a recent New York Times article, this move would be “death to innovation in America,” and we must stop it from passing!
Killing innovation in America would not only kill jobs and economic growth, it would cut off the world’s largest supply of new ideas and inventions. Recently, Eagle Forum joined several conservative groups and held a briefing on Capitol Hill. During this briefing, Dr. Raymond Damadian, the inventor of the MRI declared that if the changes Congress is proposing to make to our patent system had been in place while he was doing his research, we would not have the MRI today!
Innovation vastly improves, and can even save our lives. We must fight to protect it!
That’s why Eagle Forum and a long list of conservative leaders and organizations, including former Attorney General Edwin Meese, sent this letter to every Senator and Member of Congress urging them to oppose any so-called reform that would kill innovation.
We need you to call your Congressman today and tomorrow to tell them we need to protect innovation, not just corporations and litigation. Urge them to vote him or her to vote NO on H.R. 1249.
Note: This issue does not break down along typical liberal/conservative lines, so do not be discouraged from calling if your Congressman is liberal. Also, some very strong conservatives do not yet understand how badly this bill will impact small inventors and small business, so we need everyone to call your Members and tell them!
